Notes of the Commission Meeting of June 29, 2015

On June 29, the City Commission held a regular Commission Meeting.  The following are notes of interest (all items passed unanimously unless otherwise indicated):

ORDINANCES & PUBLIC HEARINGS - FIRST READING

ORDINANCE NO. 15O-06-122:  AMENDING THE CITY CHARTER, ARTICLE VI, CITY MANAGER, SECTION 6.02, APPOINTMENT; QUALIFICATIONS; COMPENSATION, TO REQUIRE THE PERFORMANCE REVIEW PROCESS; AMENDING THE CITY CHARTER, ARTICLE VIII, CITY CLERK; CITY ATTORNEY; BONDING, SECTION 8.01 APPOINTMENTS AND TERMINATION, TO PROVIDE FOR THE PERFORMANCE REVIEW PROCESS CHANGES BY RESOLUTION RATHER THAN ORDINANCE (REQUESTED BY MAYOR RICHARD J. KAPLAN).

ORDINANCE NO. 15O-06-123:   PERTAINING TO CAMPAIGN CONTRIBUTIONS BY CHARTER OFFICERS AND ATTORNEYS WHO ADVISE THE CITY COMMISSION; -AMENDING THE CITY CODE OF ORDINANCES TO CREATE SECTION 8-9, CAMPAIGN CONTRIBUTIONS, PROVIDING THAT CERTAIN DESIGNATED POSITIONS ARE REQUIRED TO APPLY AN UNBIASED ANALYSIS AND REVIEW ANY ELECTION DISPUTES IN THE CITY OF LAUDERHILL; TO AVOID THE APPEARANCE OF IMPROPRIETY, PERSONS FILLING THESE POSITIONS ARE HEREBY PROHIBITED FROM MAKING CAMPAIGN CONTRIBUTIONS TO ANY CANDIDATE FOR ELECTIVE OFFICE IN THE CITY OF LAUDERHILL (REQUESTED BY MAYOR RICHARD J. KAPLAN).  Tabled to the next Workshop by a 4 to 1 vote (Mayor Kaplan voting against).

ORDINANCE NO. 15O-06-125: AMEND THE RATE SCHEDULE OF FEES CHARGED BY SUN BERGERON AND BILLED BY REPUBLIC SERVICES OF FLORIDA, LIMITED PARTNERSHIP D/B/A ALL SERVICE REFUSE FOR DISPOSAL SERVICE CHARGES FOR THE TERM COMMENCING AUGUST 1, 2015.  The rate is going down slightly.

ORDINANCES & PUBLIC HEARINGS - SECOND READING

ORDINANCE NO. 15O-06-121:  LOCAL BUSINESS TAXES TO RATES BY FIVE PERCENT (5%) AS IS REASONABLE AND NECESSARY AND AS IS AUTHORIZED BY FLORIDA STATUTES, SECTION 205.0535(4).

RESOLUTIONS

RESOLUTION NO. 15R-06-139: APPROVING THE COORDINATION AGREEMENT BETWEEN BROWARD COUNTY AND THE CITY OF LAUDERHILL ASSIGNING BROWARD COUNTY AS THE “COMMUNITY TRANSPORTATION COORDINATOR” (CTC) REGARDING THE TERMS, CONDITIONS AND REGULATIONS REQUIRED TO BE ELIGIBLE TO RECEIVE THE 5310 BUS TRANSPORTATION GRANTS WHICH PROVIDE TRANSPORTATION FOR SENIORS AND DISABLED.

RESOLUTION NO. 15R-06-147:   APPROVING THE PURCHASE OF ARTIFICIAL TURF PLAYGROUND SURFACE AT JACKIE GLEASON PARK BASED UPON THE EXTENDED CONTRACT WHICH WAS APPROVED VIA RESOLUTION 14R-03-61 AS A PIGGYBACKED OF THE BIDS SOLICITED BY THE SCHOOL DISTRICT OF PALM BEACH COUNTY, FLORIDA (10C-54B); APPROVING THE PURCHASE IN THE AMOUNT OF $49,989.50 FROM SUPERIOR PARK SYSTEMS, INC.; PROVIDING FOR PAYMENT IN THE AMOUNT OF $49,989.50 FROM BUDGET CODE NUMBER 305-351-6574.

RESOLUTION NO. 15R-06-148:   WAIVING COMPETITIVE BIDDING REQUIREMENTS; APPROVING THE PURCHASE OF ARTIFICIAL TURF PLAYGROUND SURFACE AT WEST KEN LARK PARK BASED UPON THE EXTENDED CONTRACT AS A PIGGYBACK OF THE BIDS SOLICITED BY THE SCHOOL DISTRICT OF PALM BEACH COUNTY, FLORIDA (10C-54B); APPROVING THE PURCHASE IN THE AMOUNT OF $47,275.00 FROM SUPERIOR PARK SYSTEMS, INC.; PROVIDING FOR PAYMENT IN THE AMOUNT OF $47,275.00 WITH THE USE OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS FROM BUDGET CODE NUMBER 625-225-8313.

RESOLUTION NO. 15R-06-146:   GRANTING TO CRICKET CLUB, LLC A PRELIMINARY BOUNDARY PLAT DEVELOPMENT ORDER FOR 175 TOWNHOUSE UNITS ON A 10.387+ NET AND 11.81 GROSS ACRES UNPLATTED SITE ZONED RESIDENTIAL TOWNHOUSE AT FIFTEEN DWELLING UNITS PER GROSS ACRE (RT-15) DISTRICT, MORE PARTICULARLY KNOWN AS THE FORMER McARTHUR DAIRY SITE IN LAUDERHILL, FLORIDA
