NW 70th Avenue Traffic Calming Study

A study has recently been completed to study traffic problems, and traffic calming on NW 70th Avenue and Inverrary Blvd. (between University Drive and NW 70th Avenue). The study showed that peak traffic hours are at 7-8 AM and again at 6- 6 PM. Inverrary Blvd. showed that speeding of 5 or 10 MPH plus over the speed limit occurs on average between 31.7% to 27.8% of the time during the weekday. On NW 70th Avenue, it ranges on average from 5.8% to 22.8% of the time. Both depending upon time of day, and the day of the week.

During Peak AM hours Inverrary Blvd. has speeding 32.9% from 5 to 10 MPH over the speed limit, and 23.7% over 10 MPH. In Peak PM hours it is 43.1% and 33.8%, respectively. On Peak AM for NW 70th Avenue, it is 21.9% and 10.2%, and Peak PM is 18.4% and 6.3%, again respectively as to MPH.

The 85th percentile of speeding is 39 MPH on NW 70 Avenue, and 44 MPH on Inverrary Blvd. In both cases, the speed limit is 30 MPH. The conclusion is that there is a serious speeding problem on both streets which needs resolution.

Another part of the study was to determine what percentage of traffic were using these streets as a cut through the area. On Inverrary Blvd. during Peak AM hours was determined to be 9.4% of the traffic, and 9.5% during Peak PM hours. NW 70th Avenue has 9.8% and 8.6%, respectively.

The report proceeds to discuss several options to induce traffic calming. The recommendation of the report was to have "the City of Lauderhill work with the residents, through a series of public workshops, to determine which traffic calming treatments would be acceptable and effective in their neighborhood."

P.S. Follow up note: The Lauderhill Police Department has set up a special task force for Selective Enforcement by the Traffic Unit. From April 30 to May 4, 37 citations were written. Speed ranges were from 14 to 27 MPH over the speed limit of 30 MPH. Continued enforcement will be conducted.

Lauderhill Community Shuttle Bus Is A Success

In the most recent report of the Community Shuttle Bus Committee, it was shown that Lauderhill's 6 shuttle buses average over 1200 passengers/day. This is by far the most successful program in the county, and ridership is almost twice that of the second most successful program.

This program includes the newest bus #6, serving the Southeast Area of Lauderhill, which presently is not showing the ridership as needed to sustain it. Therefore, the route will be re-examined to determined how ridership can be improved.

Under the county program, the county pays $20/hour, and the city pays the difference (about $10/hour). Right now Lauderhill pays from general funds over $120,000/year to operate the buses. Cities do have the right to charge a user fee for this service or allow advertising, and with expected property tax cuts in the future, many cities may be cutting the service and/or start charging the fee and/or allow advertising. Cities have been reluctance to allow advertising on these buses due to several problems that it may impose, including content issues.

Burglary Arrest by 82nd Avenue

Due to a number of vehicle burglaries occurring during the evening hours, two officers were assigned in plainclothes and in unmarked vehicles. The location was the western area of our city, west of 82 Ave. The officers noticed a vehicle parked next to a dumpster behind a business and identified the vehicle as one that was described as being seen in the area of the burglaries. As the officers approached, both fled with one being caught on scene. The two were in the process of throwing empty purses in the dumpster after breaking into two vehicles. The person caught gave up the name of his partner and we are searching for him. The arrest has cleared three vehicle burglaries to date and more than likely will clear more.

Water Restrictions Throughout Broward Begin March 22

Because of drought conditions, the South Florida Water Management District has enacted restrictions of lawn watering, car washing and other uses. Effective March 22, lawn watering and car washing in Broward County will be limited to three days a week:

Odd addresses can water Monday, Wednesday and Saturday, 4-8 a.m. (irrigation).

Even addresses can water Tuesday, Thursday and Sunday, 4-8 a.m. (irrigation).

No watering will be permitted on Fridays.

Hand watering will be permitted on water days between the hours of 5 and 7 p.m.

Car Washing is permitted only during the times you are allowed to water your lawn, but you must wash your car on the grass.

Violators are subject to warnings, fines and jail.

Usually two-thirds of Florida's annual rainfall occurs in the five-month wet season, stretching from June to October. This year, the district received 88 percent of the average wet season's rainfall, leaving it about four inches below the target of 33.21 inches. The shortage is most notable over the district's northern, central and southeast coastal regions where rainfall deficits of up to 12 inches occurred. Lake Okeechobee’s water level is less than 11 feet, about four feet below normal. The lake is South Florida’s backup water supply.

For more information about water conservation and the new restrictions, visit http://www.sfwmd.gov/ or http://www.broward.org/watermatters.

Lauderhill's Mayor Kaplan and Vice-Mayor Holness Visit To France - February 28 to March 2

Meeting with French Senateur Jacques Pelletier, Former Ministre of France, Mayor of Villers-en-Prayeres (Aisne), President of the High Counsel for International Cooperation

The trip to France continued with stops in Nantes, Marseille and some additional meetings with Paris.

IN NANTES:

The Delegation met with numerous local leaders, including the Adjoint Mayor, Directors of the Regional Art School of Nantes, Cultural Counselor for the region, University Professors from the area and from Jacksonville, Florida, and members of their Chamber. At this meetings, a presentation was given of the history and plans for each of our respective areas. Following this meeting we toured the Isle de Nantes, which is a redevelopment of the abandoned Shipyards, which is being transformed into a restaurant and entertainment district, to be completed in 2007. Part of our group toured an Art Museum, which was formerly a cookie factory.

IN MARSEILLE:

Again, the Delegation met with local and regional leaders, including Adjoint Mayors, Chamber Members, as well as their cultural, art and promotional organizers. We were joined by the US General Consulate for Southern France.

A tour of La Friche - La Belle de Mai was conducted. This is actually 3 facilities in a formerly declining area of their city that formerly housed a tobacco company which closed several years ago. The facilities, which are adjacent to each other, are now a local archive (which is still going through and preserving materials which are available for public research), media center (for several hundred companies), and an artist institute.

Several of us toured the old abandoned Warehouse Facility, which has now been transformed into stores and offices for several hundred companies. These facilities were created through their Chamber of Commerce, which has taxing authority.

FINAL VISITS IN PARIS:

On our final day, Friday, we met with CitesUnies (United Cities), which is the equivalent of our League of Cities, as arranged by Senateur Pelletier earlier in our tour. We were advised about how this organization helps establish relationships with cities, including sister cities.

They explained they are very interested in getting more involved with the United States, and have projects already underway in this area. If we wish it, they would assist in finding a match for Lauderhill, but first we would have to prioritize our interest, and this may take some time to complete. As to their prioritizing, they are prohibited by law to recognize ethnics or minorities, but can look to regional influences. Such prioritizing could lead to arts and cultural exhibit exchanges, student exchanges, etc. These activities have been implemented many times before.

At this point it was noted that the Mayor and Vice-Mayor would bring this information back to the city for discussion and direction. Additional photos will be subsequently posted.

This mission's objectives include developing interest in establishing a Sister City relationship and Friendship Pacts in France, to promote the City’s business and cultural developments, for which the Lauderhill’s Chamber will play a significant part, relating to the Broward County Regional Park, Carishoca, Gospel Complex, All American Cultural Mall and surrounding areas, and learning about the future business plans for creating these cultural facilities.

IN RENNES:
The first two days started early at the National Cultural and Education Complex at Les Champs Libre (formerly a poverty ridden neighborhood), Rennes, France, that includes a combined Library, Children’s Science Museum with Learning Center, Planetarium, and a 450-seat conference center, where the Mayor, Vice Mayor and the Delegation met with Jacques Terrier, the Director of the Facility and Mr. Eric Beaty, US Consulate for Western France. In its first year it has received 1 million visitors.

The Lauderhill assembly also met with in the first two days:
Guy Canu, President of the Rennes Chamber of Commerce who hosted the event in Rennes (Chambers in France have taxing authority)
Clotilde Tascon-Mennetrier, the Vice-Mayor of Rennes and First VP of the Regional (County) government. (NOTE: Elected officials can hold numerous elected positions at one time. Such as a mayor can also be on its regional government, a French Senator, or hold other elected positions.)
Loic Fremont, the Director of Si Tous Les Ports Du Monde ("If All The Ports Of The World")
French Senator Pelletier (at the French Senate in Paris)

A presentation was made on the cultural development and construction going on in Lauderhill. There were follow up discussions by the ASHE Foundation on exchanging exhibits between Rennes and the "All American Museum For Cultural Diversity" to be built in the All American Cultural Mall at Carishoca in Lauderhill. Mr. Winston Fifi (AMERA), Mrs. Angela Jones (Jones Company) and Loise Lipsett-Jackson (MILLENIUM Corp) presented respectively: the CARISHOCA, the Community Children Art and Cultural Learning Center of Broward, the MILLENIUM Investment Corporation.

At the subsequent meeting with Mr. Fremont, he proposed to the Mayor and Vice-Mayor that Lauderhill join his Association, whose focus is to create connections with cities who have historical ties to ports and migration. The goal is for the Lauderhill Cultural Complex to be a platform for business development. The Mayor and Vice-Mayor did not discuss such matters between them, and instead advised that they would later need to bring this information to their Commission for discussion and interest.

Mayor Kaplan and Vice-Mayor Holness, along with the Delegation were taken by Mrs. Anne Couvez (ASHE) and Eric Beaty to the US Consulate for a meeting with Christelle Maffre, Director for the European Union of "Enterprise Florida." The Mayor and Vice-Mayor again gave a presentation on the ongoing developments of the Carishoca, Dr. Bobby Jones Gospel Complex, All American Cultural Mall, County Regional Park, Lauderhill Mall, and Lauderhill in general. The US Consulate and Director advised what their function is, and how they may be able to assist

IN PARIS :
At 10:00AM, the delegation was warmly greeted at the conference room of "CultureFrance," the world largest cultural agency, by Mr. Benoit Etienne, Director of Cooperation and Cultural Engineering, Mrs. Valerie Thfoin and Mrs. Lucie Touya in charge of the Caribbean Rim. This section of the organization is particularly involved in African and Caribbean art and cultural diversity.

Victor Haye made a video presentation on the cultural development and construction going on in Lauderhill. The Delegation was advised that in collaboration with the ASHE Foundation, that interest in exhibits in Florida can be extended to Lauderhill if they desire, though details need to be worked out. Vice-Mayor Holness inquired about whether they had an exhibit on specific American artists who have worked in France

Later in the afternoon, the Delegation met with Senator Jacques Pelletier at the French Senate in Paris. He recommended and set up a subsequent meeting with "CitesUnies" (United Cities), which is our equivalent of League of Cities. It is headed by the Senator Charles Josselin who is also a city Mayor.
CitesUnies works with French cities to establish sister cities relationships, rather than doing it directly as it was being set up. Therefore, no movement towards proceeding with any Sister Cities Relationships resulted, and the matter will be discuss further with the Lauderhill Commission to work through this organization, as is traditionally arranged in France. Subsequent visits in France were to Nantes and Marseilles, and a similar brief report shall follow.

The delegation is expected home on Saturday, the 3rd of March 2007, when they are expected to give a full report on the trip to France after assembling all of the information.

Update on Oakland Park Turnpike Exchange

A few months ago the Turnpike Authority released a new study showing how it could create a new interchange at Oakland Park Blvd., allowing for SunPass usage only. Though it is a significant improvement from their previous studies, providing several new options to overcome traffic problems, there remains several significant issues. These issues include a proposal for a traffic light on the top of the Oakland Park Blvd. bridge, which is still unacceptable.

To help facilitate this process, and at the urging of Lauderhill and Lauderdale Lakes residents and businesses, the Mayors of the two cities, with their City Managers and members of Florida Medical Center, met to discuss how to proceed in solving this situation. At that meeting in late December, it was felt that if the cities could conduct their own study, from the city's perspective, we may find a way to approve an interchange that the Turnpike Authority could accept. To date, the Turnpike studies reflect the Authority's point of view, and we believe it does not satisfactorily address the cities' concerns. The estimated cost of this study was estimated to be $40,000 to $50,000.

To pay for the study, each city would pay half, and that Mayor Kaplan, as Chair of the MPO would seek other transportation planning funds to reduce the cost to the cities. Subsequently, the MPO has agreed to pay $25,000 of the cost. Though other funding is being sought, nothing additional has been secured yet.

The idea would require the City Managers to coordinate all activity, with their city's objectives and objections in mind. When the report is complete, they are to take those elements that each city can agree with and submit them to the Turnpike Authority. It is felt that if both cities can agree with a plan, then the Authority would be more willing to accept this and move forward with a final agreed solution.

With the cities each looking at a cost of $12,500 or less, each City Manager (though it is in their authority to approve without Commission approval) decided to bring this to their Commission for comment and support. Lauderhill Commission on Jan. 8 immediately supported moving forward. The Lauderdale Lakes Commission has now discussed this matter at least 3 times, and as of yet no movement towards consensus, vote, nor decision has been made by them. A time line was requested, and it was expressed that it would not be in our best interest to go much beyond March for fear of losing the MPO $25,000 study grant.

Lauderdale Lakes is expected to bring this matter up again at their Commission meeting February 27, however, it is unclear as to how they wish to proceed in this matter. The decision to move forward with the study affecting the entire corridor rests with Lauderdale Lakes. The City of Lauderhill has conveyed that it requires both cities to be an equal contributing partner for this to proceed, and additional delays will jeopardize the ability to move forward.

If both cities can agree to proceed, and a solution acceptable to both cities is also accepted by the Turnpike Authority, construction plans then could start. The expected time for construction is unknown, but will take several years to implement.

Notes of the Regular Commission Meeting of 2/12/07

On February 12, 2007, the City Commission held a Regular Commission Meeting and a Special Workshop (to catch up on the cancellation of 3 consecutive Regular Workshop). The items and discussion on the Special Workshop were as follows:

1) Tap Tap City - Both Vice Mayor Holness and Mayor Kaplan announced that they were personally paying for the travel cost of the trip to France. They will be leading a delegation of Lauderhill business leaders. 4 of 5 Commissioner had no problem as long as personal money was being used. One Commissioner still objected in they did not believe that it would not be beneficial to the city, even though city monies are not being used. The principal of Tap Tap City is a Lauderhill resident, as well as others involved in this venture. Also, discussion was on the look of the facility. No request for funding from the city has been requested. The city has not received any design plans and discussions with the developer continue.

2) Bobby Jones Gospel Center - No plans have been submitted, but the city is awaiting a feasibility study. The Florida Black Caucus has made this development a priority to receive State funding.

3) Presentation was given concerning upcoming discussion on that will be held on creating an additional homestead exemption, and the impact to city services.

4) Proposed entryway signs into the city were viewed and discussed.

5) Update Stonebridge Gardens - presently they are moving towards completion of some units which could be occupied by the end of February or early March. However, several buildings are not near completion. Fund raising efforts are being directed with the Lauderhill Chamber of Commerce. For more information, contact the Chamber.

6) Notice was given that on February 15 at 7 PM at St. George Community Center, Dickey Consulting will be presenting to gather input on a proposed Broward Blvd. light rail proposal.

7) Old City Hall - only one Request for Proposal on redevelopment of the area. It did not meet with Commission desires. City Manager will pursue it further.

8) Red Light Enforcement - until such time that more information is available, and certain legalities are resolved in the legislature, the Commission does not wish to go further. Direction was given to the Police Chief to continue investigating this matter.

9) Broward Estates Park - discussion on the development on a Park in Broward Estates, which appears to be owned by the Association. The Association states they deeded back to the county due to the expense of maintaining it. Funds are being requested from the county to help develop it. The request is based upon the annexation transfer. The Commission by consensus agreed to arrange for it to be developed as a passive park. However, there is a concrete structure that may need to be removed from the property.

The items on the Regular Commission meeting were:

FIRST READING:

1) Ordinance proposed by the Mayor, to institute a requirement that all buildings must submit with their site plan those elements which satisfy the US Green Building Councils LEED Certification requirements. It does not mandate that any such requirements are implemented, only that they must identify them. Passed 5-0.

2) Ordinance proposed by Commissioner Berger to expand the prohibition of water flow extending to adjacent properties. Presently it is prohibited to water flow on hard pedestrian and vehicular surfaces, building walls and fences. The Planning and Zoning Board voted against recommended this item 1-4. Like the P & Z Board, the majority of the Commission felt this was not appropriate and unnecessary. Fails 1 - 4 (Commissioner Berger was the sole yes vote)

3) Ordinance proposed by Commissioner Benson to modify the vending vehicles to include only ice cream vendors and not other food vendors. Requiring annually inspection and the display registration sticker. It was found that the Ordinance, while supported to ice cream vendor vehicles, the ordinance as drafted eliminated certain provisions to food vendors that was not intended. Item was Tabled to fix this problem to address the specific concern, 5-0.

4) Ordinance proposed by Commissioner Benson to increase our Senior Homeowner Exemption another $25,000.00. No city or the County, in Broward County has passed this except for maybe the more affluent cities that have significant cash flows and/or little effect upon. Discussion concerning the proposed $25,000 additional homestead exemption being discussed to all homestead properties, and the effect to the city was brought up. Because of the unknowing situation, the Commission Tabled the item until such time that the tax structure issues are clarified, 5-0.

SECOND READING:

1) Passed on Consent Agenda Ordinance providing no more than 4 permits to erect special event banner signs within a 12 month period.

RESOLUTIONS:

1) Approved Tri Party Educational Mitigation Agreement between Lauderhill, Broward County and the School Board regarding the mitigation of the impact of students anticipated due to the Development of the remainder of units within the Lauderhill Transit Oriented Corridor, 5-0

2) Approved a policy of the city to encourage the design and implementation of green buildings as set forth by the US Green Building Council's LEED Program, 5-0

3) Approved on Consent Agenda a policy to encourage business to support direct sales tax collection allowances to the Educational Enhancement Trust Fund for Classroom Technology

4) Approved members to the 50th Anniversary Planning Committee. Two members have been appointed, passed 5 - 0. Additional volunteers are being sought. Applications can be submitted to the City Clerk.

5) Approved amendment to Lauderhill's CDBG Funds Program to be used for hurricane disaster, to add a strategy to assist applicants with paying rent, 5 - 0

Federal Telephone Tax Refund Information

Florida’s Public Counsel, Harold McLean, today issued a consumer alert to Florida telecommunications customers to be aware that this year’s federal income tax forms include a specific line item to claim a refund for long distance taxes paid between February 28, 2003 and August 1, 2006.

The telephone tax refund is a one-time payment available in 2006 to refund previously paid federal excise taxes on long-distance or bundled services. It is available to anyone who paid federal excise taxes on wireline, wireless or Voice over Internet Protocol (VOIP) service and does not apply to taxes paid for local telephone service.

The IRS is making it easier for individual taxpayers by offering a standard refund amount between $30 and $60, so that these taxpayers do not need to locate old telephone bills. Taxpayers with only one exemption may claim a standard refund of $30. Taxpayers with four or more exemptions may claim a standard refund of $60.

Taxpayers who wish to calculate their actual excise taxes paid may do so by filing IRS Form 8913, which itemizes the actual payments for each month starting March 2003 and ending July 2006.

The telephone tax refund will be available only for tax returns filed in 2007 for the 2006 tax year. Because of the IRS rulings, telecommunications companies no longer are billing the tax for long-distance or bundled services. The Department of the Treasury estimates that the total refunds will amount to $10 billion this year. More information regarding the refunds is available on the Internet at http://www.irs.gov/.

Editor's Note: I have been informed that the refund is available even to those that do not have to file an income tax return.
