Celebrate Arbor Day and Lauderhill Becoming a "Playful City USA"

On Monday, November 1, the City of Lauderhill Invites You to Celebrate Arbor Day, Becoming a “Playful City USA,” and the Opening of the New Park on NW 47 Avenue.

The Arbor Day and “Playful City USA” Celebration will take place at 10 am; and the Ribbon Cutting / Grand Opening for the NW 47 Avenue Park at 11 am.

The historic site of Lauderhill’s First City Hall (1080 NW 47th Avenue) is about to re-open to the community - but this time as a brand new park! The old City Hall building from Lauderhill’s inception built in 1959 was demolished after Hurricane Wilma damaged it beyond repair. At the request of United Homeowner President, Walton Hunter, the Lauderhill Commission eagerly welcomed the idea to build a community park in the neighborhood.

With community input, the park’s architect Barranco Gonzalez, Inc. designed a passive park which features a playground area, a decorative fountain, gazebo, colorful outdoor benches and tables. There is also a walking trail and small amphitheater to be adorned with public art. “Public art - is yet again - being placed in one of our parks. As the Chair of the Public Art Board and a Commissioner of the City, I couldn’t be prouder to build a beautiful new park in my own community,” states Commissioner M. Margaret Bates. Phase II of this new park will include a community room.

At 10 am on Monday, November 1st, join Lauderhill’s youth as they acknowledge and celebrate Arbor Day and Lauderhill’s new “Playful City USA” designation as they plant several trees and plants in the park’s garden before jumping on the brand new playground equipment! This hands-on planting project allows Lauderhill students to partake in making the City clean and green while acknowledging Arbor Day! As a newly designated “Playful City USA,” it is important that the youth who live in the area feel a sense of pride and ownership for their park and feel encouraged to play in it often.

At 11 am, join the Mayor, City Commission, and United Lauderhill Homeowners’ Association and celebrate Arbor Day, Playful City USA, and the Ribbon Cutting Ceremony of the NW 47 Avenue Park. Light refreshments will be served.

FDOT Settles Lawsuit on Peeling Light Poles

Florida Department of Transportation has agreed to a settlement with Defendants on the defective peeling light poles that were installed throughout Broward County. The poles have been an issue for residents everywhere, including Lauderhill, and were unsightly.

The Settlement calls for the subcontractor to repaint and repair most of the poles, and some will be replaced. Work is expected to begin early next year.

While the location of the poles are throughout Lauderhill and Broward County, it is noted that many of them within Lauderhill (but not all) are on 55th Ave., 56th Ave., 68th Ave., Atrium, Inverrary, Rock Island, University Drive, and Oakland Park Blvd.

Notes of the CRA, Special Workshop and Commission Meeting of October 25

On October 25, the City Commission held a regular CRA and regular Commission Meeting, the last of the legislative session before the elections. The following are notes of interest (all items passed below unanimously unless otherwise indicated):

CRA MEETING:

1) EXTEND INTERNATIONAL TRADE INCUBATOR LEASE

ITEM#1: RESOLUTION NO. 10R-10-04: AUTHORIZING THE COMMUNITY REDEVELOPMENT AGENCY DIRECTOR TO EXECUTE AN EXTENSION OF THE LEASE FOR THE INTERNATIONAL BUSINESS INCUBATOR AT 1711-1717 N.W. 38TH AVENUE; PROVIDING FOR AN EXTENSION THROUGH SEPTEMBER 30, 2011 AT THE SAME MONTHLY RATE; PROVIDING TERMS AND CONDITIONS; PROVIDING FOR CONFLICTS.

SPECIAL COMMISSION WORKSHOP

The only item was a report on the expenditure of NSP Funds by the City. The following are notes from that report:

Lauderhill received $4.293 M which is required to be obligated by 9/4/10. We obligated 100% by 8/28/10. 25% or $1.073 M was required for low income. We exceed this and provided for low income 35% or $1.469 M.

Lauderhill has 48 months to expend or 3/3/13 the $4.293 M. By 10/22/10 we have expended 58%, which is one of the highest rates nationwide.

Down payment and closing costs assistance has 17 recipients, and 11 so far have closed for $786,812.

The City purchased 28 properties, 5 sold, 6 are under contract, 4 schedule to close by end of October. Financing option provided by Lauderhill Housing Authority in the amount of $552,000.

Program impediments primarily is the resale of condominiums purchased since condominiums are not approving the sale from the city to new residents. The problem is their income restrictions. If we cannot sell the units, we could rent them.

To our knowledge, we have been advised that Lauderhill is one of the most successful cities in the US in complying with this program, and we have received an additional $1.5 M to expend under this program. Only a few cities even comes close to matching our compliance with this federal program.

Lauderhill Police Department’s Halloween Safety Day Event

The Lauderhill Police Department will host their 2nd Annual Halloween Safety Day Event to provide safety tips for kids and their parents. Bring your kids out to meet our Police Officers, Firefighters, Police Explorers, and our Citizens on Patrol Volunteers. Early Voting Begins


Early voting for the November elections begins today. Voting can be done at several centers around the county from today through October 31, but not on Sundays.

The Early Voting Precincts in Lauderhill, or adjacent to the city are at the Lauderhill Mall and at the Tamarac Library on Commercial Blvd.

If you are unable to Early Vote or Absentee, then you can vote at your regular precinct on Tuesday, November 2 from 7 am to 7 pm.

As a reminder, eLauderhill News has recommended to elect Joel Leshinsky for Lauderhill Commission Seat 2 and re-elect M. Margaret Bates for Lauderhill Commission Seat 3.

Amendment #1 - Repeal of Public Campaign Financing requirements - NO.

Amendment #2 - Homestead ad valorem tax credit for deployed military personnel -YES

Amendment #4 - Referenda required for adoption and amendment of local government comprehensive land use plans - NO. In Broward County alone it would virtual stop all future land use changes even when wanted by the public, and it is feared the public would pay for the ballot initiatives in their city and county-wide.

Amendment #5 - Standards for Legislature to follow in legislative redistricting -YES

Amendment #6 - Standards for Legislature to follow in congressional redistricting - YES

Amendment #8 - Revision of the class size requirements for public schools - YES

Referendum - A Non Binding Referendum calling for an Amendment to the US Constitution to require a balanced federal budget without raising taxes - NO. Not because we don't agree with the concept, on the contrary. However, the language on the ballot is not the same as the explanation, and therefore is believed misleading.

BROWARD COUNTY CHARTER REFERENDUMS:

#1 Charter Review Commission and Management and Efficiency Study Commission should meet every 10 years instead of 6 years - NO. Though it costs more, the public needs to be able to make changes to their government through such procedures more often.

#2 County Ethics Code shall control over Municipal Ethic Codes - No. Not because there shouldn't be a Municipal Ethic Code, but that the Charter Review Commission made changes that were written specifically for the County, and not Municipalities. Instead the same independent board of residents should create such a Code and not the County Commissioners who were resistant to create a code of their own.

#3 Broward County Constitituional Officers to be subject to the Broward County Code of Ethics - Yes.

#4 Establish a Charter Officer of Inspector General to investigate county and municipal misconduct and gross mismangement - Yes. However it should have been a Constitutional Officer.

#5 To send direction to the Legislature that Broward County Residents want the County to be able to show on the tax bill the share of property taxes that is attributable to Constitutional Officers - Yes.

Candidates for Lauderhill City Commission Meet at Environ

On October 27, beginning at 6:30 PM, the Candidates for Lauderhill City Commission, Seat 2 and 3, will be presented to the public. The meeting will take place at the Environ Cultural Center and is open to the Public. The Public may ask questions of the candidates. The ECC will be conducting this Meeting.

Also, anyone with an Absentee Ballot may bring it to the Meeting. The ECC is collecting absentee ballots up until Oct. 29 at 3 PM. Then they will hand deliver the ballots to the Supervisor of Elections Office.

The Florida Department of Financial Services will host a Housing Help Workshop designed to educate and assist families facing foreclosure. The workshop will include opportunities to meet personally with mortgage lenders, HUD-certified housing counselors, Lauderhill Housing Authority, legal assistance, credit counseling services,and many other foreclosure assistance programs. Also receive information on home weatherization programs and tips for reducing home insurance premiums.

BCT Cost of Bus Fares and Passes Increases Effective October 1, 2010

At the September 14 public hearing, the Broward County Commission voted to increase the cost of bus fares and passes. Click here for new fare rates. All current bus passes will continue to work through their expiration date.

Broward County Transit’s transfer fee structures to and from Miami-Dade, Palm Tran and Tri-Rail transit systems will remain the same.

Lauderhill Press Release on Transfer of County Facilities in Annexed Areas

The City of Lauderhill Would Like to Update Residents Regarding the Transfer of Water/Sewer Services as Well as the Title of Fire Station #14 from Broward County to the City of Lauderhill.

The City of Lauderhill is still waiting for Broward County to transfer the water/sewer services for the recently annexed areas of West Ken Lark, St. George and Broward Estates. Consequently, the City still has no title or access to the existing Fire Station #14 located within the corporate limits of the City of Lauderhill, and is still operating its Fire Rescue Department out of a temporary triple-wide trailer Fire Station constructed on NW 31 Avenue.

It has been and still is the City’s position that the use of taxpayer’s funds to build the temporary Fire Station was prompted by the County’s failure to act in good faith. The dollars spent on the Station could have been utilized for other projects in the City of Lauderhill – especially the proposed projects in the areas near 441.

Additionally, the City continues to pursue transfer of the water and sewer infrastructure in our annexed areas of West Ken Lark, St. George and Broward Estates so all of our citizen’s can receive the same services.

The frustration expressed by residents is mounting because of the continued position of Broward County to withhold the assets that they rightfully own as residents and taxpayers of the City of Lauderhill. We ask that you share your concerns with your County Commissioners and ask them to relinquish these assets to the City of Lauderhill immediately.

PURSUANT TO A NEGOTIATED SALE.

4. ORDINANCE NO. 10O-09-155: AUTHORIZING INDEBTEDNESS IN THE FORM OF A LOAN IN THE AGGREGATE PRINCIPAL AMOUNT OF $10,000,000 FOR THE PURPOSE OF FINANCING, INCLUDING THROUGH REIMBURSEMENT, THE COST OF ACQUIRING, CONSTRUCTING, IMPROVING, EQUIPPING, REPAIRING AND RENOVATING VARIOUS PUBLIC FACILITIES, ALL AS SHALL BE SET FORTH IN THE CITY’S ADOPTED FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM FROM TIME TO TIME; AUTHORIZING EXECUTION AND DELIVERY, OF A LOAN AGREEMENT WITH SUNTRUST BANK AND THE EXECUTION AND DELIVERY OF A PROMISSORY NOTE IN CONNECTION THEREWITH; PLEDGING THE REVENUES RECEIVED BY THE CITY FROM THE LEVY AND COLLECTION OF THE CITY’S WATER SERVICE UTILITY TAX TO PAYMENT OF THE AMOUNTS DUE UNDER THE LOAN AGREEMENT AND PROMISSORY NOTE; AWARDING THE LOAN TO SUNTRUST BANK PURSUANT TO A NEGOTIATED SALE.

5. ORDINANCE NO. 10O-09-156: APPROVING A SUPPLEMENTAL APPROPRIATION IN THE TOTAL AMOUNT OF $1,170,000.00 TO BALANCE THE FISCAL YEAR 2010 BUDGET.

6. ORDINANCE NO. 10O-09-157: AMENDING THE CODE OF ORDINANCES CHAPTER 21, WATER AND SEWER SERVICE, TO INCREASE WATER AND WASTEWATER SERVICE RATES WITH SAID INCREASE NECESSARY TO COVER THE COSTS OF PROVIDING SAID SERVICES TO THE RESIDENTS OF THE CITY IN ACCORDANCE WITH THE AUTOMATIC RATE ADJUSTMENT CONSISTENT WITH THE CONSUMER PRICE INDEX; PROVIDING FOR THE NEW RATE STRUCTURE TO COMMENCE OCTOBER 1, 2010.

7. ORDINANCE NO. 10O-09-158: AMENDING THE CODE OF ORDINANCES, CHAPTER 3, ALCOHOLIC BEVERAGES, SECTION 3-4, HOURS DURING WHICH SALES ARE PROHIBITED; PROVIDING THAT ALCOHOLIC BEVERAGE SALES FOR CONSUMPTION OFF PREMISES IS PROHIBITED EVERYDAY FROM 2:00 A.M. TO 7:00 A.M.; (REQUESTED BY MAYOR RICHARD J. KAPLAN). Withdrawn to comply with correct Local Planning Agency procedure, so a new first reading will be on September 29.

ORDINANCE NO. 10O-09-159: AMENDING THE CODE OF ORDINANCES, APPENDIX G - FRANCHISES, ARTICLE III, GARBAGE, REFUSE AND TRASH; APPROVING THE AMENDMENT TO THE SCHEDULE OF RATES, FEES AND CHARGES PURSUANT TO THE FRANCHISE AGREEMENTS WITH WASTE MANAGEMENT, INC. AND INCORPORATING THEM INTO THE CITY CODE OF ORDINANCES; PROVIDING FOR AN EFFECTIVE DATE OF OCTOBER 1, 2010.
